1. Acceptance of Terms
These Terms and Conditions govern all tax preparation services provided by Daye2Daye LLC (“Daye2Daye,” “we,” “us,” or “our”) to any individual or business client (“you” or “your”). By engaging Daye2Daye for services, submitting documents through our secure upload portal, or electronically signing an engagement agreement, you agree to be bound by these Terms.
2. Services Provided
Daye2Daye provides professional tax preparation services, including:
- Individual Tax Preparation — Federal and state individual income tax returns (Form 1040)
- Business Tax Preparation, covering the following entity types:
- Single Member LLC (reported on Schedule C)
- Multi Member LLC / Partnership (Form 1065)
- S Corporation (Form 1120-S)
- C Corporation (Form 1120)
The specific return types, tax years, and scope of work for your engagement will be identified in your engagement agreement or written confirmation.
3. Client Responsibilities
You agree to:
- Provide complete, accurate, and truthful information and documentation.
- Respond promptly to requests for missing or clarifying information.
- Review your completed return before it is filed and notify us of any errors.
- Provide all records required to support income, deductions, and credits.
- Notify us of any changes to your contact information, filing status, or business structure.
Daye2Daye relies on the information and documents you provide. We do not independently audit or verify your records.
4. Engagement and Scope
An engagement is created only when you and Daye2Daye agree on the services to be provided, whether through a signed engagement letter, written confirmation, or scheduling through our booking system. We reserve the right to decline or discontinue any engagement, consistent with professional standards.
5. Fees and Payment
When Daye2Daye collects its fee directly from your refund, no upfront payment is required; the fee is deducted from your refund before the remainder is disbursed to you. When your return does not result in a refund, or Daye2Daye is not collecting its fee from a refund, payment of the full fee is due upon completion of your return. If payment is due upon completion and has not been received, your return will not be transmitted until payment is collected. Fees are earned for professional time and work performed, regardless of whether you choose to file or use the completed work.
6. Accuracy, Estimates, and IRS Review
- Quotes and estimates are subject to revision if your return becomes more complex than initially described.
- Daye2Daye prepares returns based on the information you supply and applicable federal and state law at the time of preparation. Changes in law or IRS/state interpretations after filing may affect outcomes.
- If your return is selected for examination or review by the IRS or a state agency, Daye2Daye is not obligated to represent you unless a separate representation engagement is agreed upon in writing.
7. Confidentiality and Data Security
Daye2Daye takes the protection of your personal and financial information seriously.
- We maintain a Written Information Security Plan (WISP) consistent with IRS Publication 5708 and the FTC Safeguards Rule.
- Sensitive documents should be uploaded only through our designated secure upload service; please do not send tax documents through regular email, text, or website chat.
- We access your information only as needed to prepare your returns and will not share it with third parties except as required to process your return, comply with law, or with your written consent.
8. Scheduling and Communication
Appointments may be scheduled through our online booking system. If you need to reschedule or cancel, please do so as early as possible so we can offer your time to other clients. Repeated missed appointments may affect our ability to complete your return before filing deadlines.
9. Amendments and Corrections
If you discover an error after your return has been filed, notify us promptly. We will review the matter and, where appropriate, prepare an amended return. Fees for amended returns may apply and will be discussed with you before work begins.
10. Limitation of Liability
Daye2Daye’s liability arising from any engagement is limited to the fee paid for the specific return or service giving rise to the claim. We are not liable for penalties, interest, or losses resulting from inaccurate, incomplete, or late information you provide.
11. Indemnification
You agree to indemnify and hold Daye2Daye harmless from claims, penalties, or expenses arising from information you provided that was inaccurate, incomplete, or fraudulent, or from your use of a completed return contrary to our advice.
12. Termination
Either party may terminate an engagement at any time with written notice. You remain responsible for fees for work performed up to the date of termination.
13. Governing Law
These Terms are governed by the laws of the State of Nebraska.
14. Electronic Signature and Consent
By electronically signing an engagement document or checking an acceptance box, you consent to conduct this transaction electronically and agree that electronic signatures have the same force as written signatures.
